Scope, contractual partner and conclusion of contract

These terms and conditions apply to contracts for the rental of rooms for accommodation as well as to all other related services provided by Manz Privacy Hotels Switzerland AG and its establishments (hereinafter referred to as "MPH"), represented by MANZ PRIVACY HOTELS SWITZERLAND AG, Untermüli 9, 6302 Zug , Switzerland.

The following companies belong to the "MPH":

Hotel St. Gotthard, Zurich (Manz Privacy Hotels Switzerland AG)

Hotel Continental, Lausanne (Manz Privacy Hotels Switzerland AG)

Hotel Euler, Basel (Euler AG)

Hotel City Inn, Basel (Euler AG)

Hotel Metropol Basel / Hotel Metro AG)

The contractual partners are "MPH" and the guest. If a third party has reserved one or more rooms for the guest, he and the guest are jointly and severally liable to "MPH" for all obligations arising from the concluded contracts. In this case, the guest and the third party are jointly and severally liable.

A contract is concluded when payment of the entire booking amount has been made with a credit card when booking online or when booking directly at the check-in terminal. The "MPH" sends an electronic booking confirmation to the guest. The subletting or other transfer of the rented rooms to third parties as well as their use for purposes other than accommodation require the prior written consent of "MPH".

By concluding the contract, the contractual partner acquires the right to normal use of the rented rooms, the facilities of the "MPH" operations, which are usually accessible to guests for use without special conditions. The guests are aware of the fact that the staff of the "MPH" companies are only available to a very limited extent and that the guest has to show personal responsibility.

The contractual partner must exercise his rights according to the house rules.

Booking and withdrawal

The booking is made online or at the check-in terminal. The advance payment of the entire booking amount is made by credit card.

The contractual partner does not acquire the right to be provided specific rooms if this has not been explicitly agreed.

After the conclusion of the contract, the guest can withdraw from the contract until 6:00 p.m. on the day of arrival. If a free right of withdrawal is agreed in writing with the guest outside the applicable 6:00 p.m. period, the guest can withdraw from the contract free of charge until then. The right of withdrawal expires if the guest does not exercise it in writing to "MPH" by the agreed date. If no free right of withdrawal has been agreed in writing outside the applicable 6:00 p.m. deadline, "MPH" is entitled to invoice the agreed prices and to debit their credit card unless the guest withdraws due to the withdrawal of circumstances for which the "MPH" is responsible. The "MPH" recommends taking out travel cancellation insurance in any case.

If the guest's right to withdraw free of charge has been agreed in writing within a certain period of time, the "MPH" is entitled to withdraw from the contract during this period if other guests have inquired about the contractually booked rooms and the guest is asked by the "MPH" does not waive his right to withdraw.

Furthermore, "MPH" is entitled to extraordinary withdrawal from the contract, for example if:

- Force majeure or other circumstances for which "MPH" is not responsible make it impossible to fulfill the contract;

- Rooms are booked with misleading or false information about essential facts, e.g. about the guest or the purpose;

-the "MPH" has justified cause to assume that the use of the services of the companies can jeopardize the smooth business operations, the security or the reputation of the companies in the public, without this being attributed to the sphere of control or organization of the "MPH" is.;

- there is a violation of point 1, second paragraph of these terms and conditions;

- makes a significantly disadvantageous use of the premises or, through his reckless, offensive or otherwise grossly improper behavior, spoils the other guests, the owner, his people or third parties living in the accommodation facility from living together or acts against these people with a punishable act is guilty of property, morality or physical security;

- is attacked by an infectious disease or an illness that goes beyond the duration of the accommodation or otherwise requires care;

-the stay is illegal.

If the guest withdraws from the "MPH" for the reasons mentioned above, the guest has no right to compensation.

Check-in and check-out

Check-in takes place via the terminal provided for this purpose or directly at reception. After completing the check-in, the guest receives the room card directly via the terminal or from reception. The room card must be inserted in the box provided for this purpose when leaving the "MPH" premises. The room is available from 2 p.m. on the day of arrival at the latest. On the agreed departure date, the rooms must be vacated by 12 noon at the latest. The "MPH" is entitled to invoice an additional day if the rented rooms are not vacated on time.

Prices and means of payment
All prices quoted in price lists, on websites or elsewhere are in Swiss francs and include statutory VAT. The prices result from the conclusion of the contract or the underlying price list. Changes to bookings entitle "MPH" to request different prices, e.g. change the number of rooms booked or the length of stay of the guests.

Smoking ban and fire protection

The following fire protection regulations must be observed in the entire building of all "MPH" operations. Only items and devices belonging to the room furnishings may be used.

The use of kettles, ovens, toasters, immersion heaters, electric irons and similar devices is prohibited.

If an attempt is made to willfully put the fire alarm out of operation, a penalty fee of at least CHF 1,000.00 per room will be charged. In addition, the guest will be charged for all other consequential costs.

According to the law of December 13, 2007 on the protection of non-smokers and advertising for, smoking is prohibited in the interior of the "MPH" establishments.

In the event of an erroneous or improper alert to the fire brigade, a fee of at least CHF 1,000.00 plus the fire brigade's deployment costs will be passed on to the person responsible.

Baby cots must be reserved by email 24 hours prior to arrival. Prices according to the price list.

Pets

Bringing a pet requires the approval of the "MPH". The guest is obliged to announce the wish to bring a pet in advance. If the "MPH" agrees to bring the pet, this is done on the condition that the pet is under the constant supervision of the guest, is free from diseases and does not pose any other danger to the hotel guests and hotel staff. It is not permitted to take the animal with you at breakfast or in the public or gastronomic areas of the "MPH" hotels. There is a fee of CHF 30.00 per night for the pet. Exceptions are blind, deaf and other comparable service dogs. These can be carried free of charge and at any time.

Services

Various snacks, drinks and hygiene items are available to the guest for a fee.

Furnishing

The "MPH" has the following facilities: high-speed WLAN in all establishments, high-quality non-smoking rooms, flat screen TV / radio, alarm clock, international TV channels, safe, darkenable rooms, large desk.

Fitness and wellness (not available in every establishment)

The "MPH" provides guests with a small wellness and fitness area in some establishments. The equipment is in good condition. The use of the equipment is at your own risk and without supervision. The "MPH" rejects any liability. Sport and wellness should serve recreation. Guests with poor health or fatigue should refrain from using it.

The "MPH" is liable for the property brought in by the guests in accordance with the statutory provisions. The "MPH" is only liable if the items have been handed over to the "MPH" or to people authorized by the "MPH" or have been brought to a location designated by them or designated for this purpose.

Liability for slight negligence is expressly excluded. If the guest is injured or is not satisfied with the services provided by the "MPH", he must report this to the "MPH" immediately, otherwise no rights can be asserted.

All claims against the "MPH" become statute-barred six months after the guest's departure, unless mandatory statutory provisions provide for longer periods.

If the contractual partner is an entrepreneur, liability is also excluded for gross negligence.

Internet

The "MPH" provides free internet access through WLAN.

The "MPH" assumes no liability for failures of the Internet, damage by third parties, imported data of all kinds (viruses, worms, Trojan horses, etc.), as well as for links to and from other websites. The "MPH" has no control over the content and form of external websites.

"MPH" cannot guarantee that hardware and software will function properly. The "MPH" would like to point out that this page may contain technical inaccuracies or typographical errors.

In no case is the "MPH" liable to the guest or third parties for any direct, indirect, special or other consequential damage resulting from the use of this or a linked website. Any liability for lost profit, business interruption, loss of programs or other data in the guest's information systems is also excluded. This also applies if express reference is made to the possibility of such damage.

"MPH" undertakes to maintain the confidentiality of the guest's personal data. The "MPH" provides the guest with content or services from other websites through links on this page.

All information (in particular prices, reservations, online calculations) are without guarantee. "MPH" cannot guarantee that this data is completely up to date at all times. Changes or additions to the contract and the reservation confirmation are always made in writing, if possible, and are published on the website.

Unilateral changes or additions are ineffective. By paying for the booking, the guest accepts the general terms and conditions.

This contract and all disputes arising from it are exclusively subject to Swiss law.

The place of jurisdiction is the seat of "MPH" or the ordinary place of jurisdiction of the defendant.
